PART III: PLATFORM SERVICES, RIGHTS AND OBLIGATIONS OF THE PARTIES
§ 7. Services and Platform Modifications
- Dom Kamienia offers buyers and sellers a variety of support services as part of its diverse range of Products; these services are governed by the terms and conditions of the specific order or by separate agreements.
- Dom Kamienia reserves the full right to modify the range of services provided, the functionality, the tools, as well as the layout and appearance of the domkamienia.pl website at any time, without the need to obtain the consent of its customers.
- The option to sell STANDARD or PREMIUM packages (marketplace and listing ads) is an additional service activated at the user’s express request, following prior positive verification of their company by Dom Kamienia. Dom Kamienia reserves the right to refuse to activate the seller option without providing a reason.
- The additional service referred to in paragraph 3 is not an integral or inseparable part of STANDARD or PREMIUM accounts. Failure to activate the service, refusal to activate it, or its deactivation at any time by the Operator does not constitute grounds for any claims for damages or for a refund of the fee for access to the Platform.
§ 8. Customer Obligations and Rules for Posting Ads
- The customer is solely responsible for all telecommunications and IT costs, as well as the costs of equipment, equipment maintenance, and Internet access necessary to connect properly to the Platform.
- Every customer registered as a business in the Dom Kamienia database and posting commercial listings on the domkamienia.pl website declares that they are familiar with, understand, and accept without reservation the detailed rules for adding offers and listings available at: https://domkamienia.pl/dolacz-do-gieldy/.
- A customer posting listings on the Platform represents and warrants that the Goods offered by them (including raw materials, equipment, and machinery) are entirely genuine, have not been counterfeited, are free from legal defects, and come from legitimate, verified sources.
- Each Customer is personally and fully responsible for the content of correspondence exchanged with other users through the Platform's tools.

If such practices are detected, the Customer’s Account will be immediately suspended or deleted.
- The specific terms and conditions governing transactions between Users (in particular, prices of goods, delivery costs and deadlines, technical specifications of stone products, manufacturer’s warranty terms, contractual penalties for late acceptance or quality inspection procedures) are determined on a case-by-case basis and directly between the parties to a given transaction, through separate agreements, orders, or approved specifications, without the involvement or intermediation of Dom Kamienia.
§ 9. Comments and Ratings System
- A customer acting as the buyer in a given transaction has the right to leave feedback for the seller (with a rating of positive, neutral, or negative) within a maximum of 2 months from the date of the transaction (this period is calculated from the date the seller issues the purchase invoice).
- Only one comment may be posted per trade.
- An amicable resolution of a complaint or commercial dispute between a seller and a buyer outside the Platform does not result in the automatic removal of a negative review from the seller’s profile on the Platform.
- A negative comment may be removed or modified by the Platform administrator only upon an explicit, documented request from the Customer who posted the comment (the buyer). Dom Kamienia does not interfere with the content of reviews unless they violate the law or are contrary to public decency.
PART IV: B2B RELATIONSHIPS AND FINAL PROVISIONS
§ 10. Complete Exclusion of Consumer Protection and Warranties
- This Platform is a strictly closed B2B system. The Parties expressly confirm that they are entering into agreements directly related to their business and professional activities.
- A customer operating as a sole proprietor (an individual entering into a contract directly in connection with their business activities) hereby declares and confirms that their use of the Platform and their purchase of databases and STANDARD/PREMIUM packages is of a professional nature for them, directly resulting from the scope of their business activity (as listed in CEIDG).
In connection with paragraph 2, pursuant to Article 385(5) of the Civil Code, the application of consumer protection provisions—including the right to withdraw from a distance contract within 14 days without giving a reason and the right to cancel a paid order—is completely excluded with respect to any Customers (including JPG). Placing an order and paying for it results in the immediate delivery of digital content (databases), which precludes the possibility of a refund.
- Pursuant to Article 558, § 1 of the Civil Code, to the extent that Dom Kamienia could be considered a party to any delivery, Dom Kamienia’s liability under the warranty for physical and legal defects is completely excluded.
- Dom Kamienia’s total liability for damages on any grounds (including technical interruptions in the Platform’s operation, data loss, or database errors) is limited to the actual damage and may not exceed an amount equal to one month’s subscription fee paid by the Customer in question. Under no circumstances shall Dom Kamienia be liable for lost profits (lucrum cessans) of the Customer or third parties.
§ 11. Governing Law and Jurisdiction
- All agreements, orders, and legal relationships entered into or carried out under these Terms of Use of the Platform are governed exclusively by Polish law.
- In matters not covered herein, the relevant provisions of the Civil Code and the Act on the Provision of Electronic Services shall apply.
- Any disputes arising from contracts, orders, or the use of the Platform shall be resolved exclusively by a Polish court of general jurisdiction with local jurisdiction over the registered office of Dom Kamienia Sp. z o.o. in Warsaw.
§ 12. Amendments to the Rules and Regulations
- Dom Kamienia reserves the right to make changes to this document at any time for valid reasons (e.g., changes in the law, the implementation of new technologies, a change in the business model, or security considerations).
- Customers will be notified of changes to the Terms and Conditions via email or through an announcement on the Platform. The changes will take effect on the date specified by Dom Kamienia, no sooner than 7 days after their publication.
